U.S. Senate Excludes Staking and NFTs from Securities Classification in Latest Clarity Act Draft

On the 6th, the Senate Banking Committee released the latest version of the Cryptocurrency Market Structure Bill (Clarity Act), reflecting feedback from stakeholders and lobbyists. Staking, airdrops, and NFTs are excluded from securities classification unless they are fraudulent, and enforcement actions on tokens issued before the enactment of the bill are also limited. This was reported by former Fox Business reporter Eleanor Terrett, among others. The new version adds a complete exemption from securities laws for Decentralized Physical Infrastructure Networks (DePIN). It also clarifies that the offering, sale, or transfer of NFTs does not constitute a securities transaction or an investment contract sale, thereby clarifying the legal status of digital assets.
