Japan's Financial Services Agency Considers Treating 105 Crypto Assets as 'Financial Products' for Application of Financial Instruments and Exchange Act

Applying Disclosure and Insider Trading Regulations

The Financial Services Agency (FSA) has reportedly solidified its policy to treat crypto assets (cryptocurrencies) as subject to the Financial Instruments and Exchange Act (hereinafter referred to as the FIEA). According to a report by Asahi Shimbun on the 16th, authored by financial correspondent Toshizai Horikago, the plan involves applying disclosure obligations and insider trading regulations to 105 crypto asset brands handled by domestic exchange operators. The amendment to the FIEA is aimed to be submitted during the ordinary session of the Diet in 2026. According to the latest data from the Japan Virtual and Crypto assets Exchange Association (JVCEA), the number of crypto assets handled by Class I members in Japan totals 119.
